Terms and Condition of Business of the Pitztal Tourist Office for bookings via
www.pitztal.comI.
Area of Application, Conclusion of Contract Pitztal
Tourist Office enters into a business relationship with a booker as an intermediary.
A contract is thus concluded between the booker and the accommodation provider.
This contract is subject to the following General Terms and Conditions of Business
in the version prevailing at the time of booking. Any reciprocal claims deriving
from this contract are only to be asserted against the immediate contractual partner
and without any liability on the part of the Pitztal Tourist Office. The Pitztal
Tourist Office agrees with the booker that the "Austrian Hotel Contractual
Conditions (ÖHVB)" passed at the 93rd Committee Meeting of the Hotelier
Trade held on 23.09.1981 as well as the supplemental General Terms and Conditions
of Business mentioned here have legal force for the accommodation contract as
well as for the mediation of the same. The ÖHVB is available for download:

II. Special emphasis is placed on the section "Cancellation"
and reproduced in excerpt form here:: - Both contractual partners,
i.e. both the booker and the accommodation provider can unilaterally cancel the
accommodation contract without requiring to pay a cancellation fee up to 3 months
at the latest before the agreed date of arrival of the booker. The notification
of cancellation must be received by the contractual partner within the prescribed
period. In this case the down payment is to be reimbursed or credited to the booker
and the invoice for the mediation fee cancelled.
- Up to 1 month
at the latest before the agreed day of arrival of the booker, the accommodation
contract can be terminated by both contractual partners via a unilateral notification.
Here, too, the notification of cancellation must be received by the contractual
partner within the prescribed period. However, a cancellation fee is to be paid
amounting to the room price for 3 days. In this case, the mediation fee amounts
to 10 % of the cancellation fee. In this case a percentage of the mediation fee
would be possibly reimbursed or credited.
- If the booker does
not cancel up to 1 month at the latest before the day of arrival, he is obliged
to pay the agreed sum. Nevertheless, the accommodation provider must deduct what
has been saved due to the room not being let (this is as a rule 20% for the room
price and 30% for the price of board) or what he has received by letting the accommodation
to others. A duty to minimize damages exists, i.e. the accommodation provider
is to attempt to let the rooms that have not been taken up to others . The mediation
fee of the Pitztal Tourist Office in the original amount remains unchanged, however.
In the event of a cancellation within one month, the cancellation
invoice is sent to the booker only following the original dates of stay..
The Pitztal Tourist Office will offer a voyage cancellation insurance for
every booking the booker makes. The premium is charged to the booker..
III. Supplemental General Terms and Conditions of Business:
- The contractual partner agree on Austrian Law for the accommodation contract
as well as the mediation contract. No additional agreements are made.
- No
additional agreements are made.
- Alterations and supplements to this contract
must be made in writing to be legally effective.
- It is agreed that the
Regional Court of Silz has legal jurisdiction in any disputes arising out of this
legal transaction - also those concerning the existence of the legal transaction.
Place of performance is Pitztal.
- The accommodation provider expressly
confirms that the Austrian Hotel Contractual Conditions have legal validity for
all mediations, and, additionally, the accommodation provider declares to know,
have received and to accept in full the General Terms and Conditions of Business
for every mediation.
- The Pitztal Tourist Office applies the prevailing
data protection acts when processing person and company related details. The data
received is solely collected, processed and utilised insofar as it is required
for the justification, form or alteration of its own as well as, if need, be mediated
business relationships. The Pitztal Tourist Office is entitled to pass on this
data to partners commissioned by the Pitztal Tourist Office insofar it is necessary
to process reservation queries or bookings.
- If the guest expressly agrees
his/her consent, the Pitztal Tourist Office is furthermore entitled to record,
process and use the data received from the guest for the purposes of advising,
advertising, market research as well as to devise offers.
- No guarantee
can be given for the content and the correctness of the picture material provided
by the accommodation provider.
- When paying the required down payment the
booker issues his irrevocable consent to cashless debiting via the respective
bank. It is pointed out that the credit card institute of the Pitztal Tourist
Office is possibly not identical with the credit card institute of the accommodation
provider.
General Terms and Conditions of Business of the Pitztal
Tourist Office for orders via the web shop on www.pitztal.com/webshop
- All deliveries and services of the Pitztal Tourist Office arising from online
orders via the internet or other online services are subject to these Terms and
Conditions of Business.
- The risk passes to the customer as soon
as the merchandise has been handed over to the transport company and has left
the warehouse. This also applies when the Pitztal Tourist Office bears the transport
costs. The customer is to make complaints about transport damage directly to the
transport company within the prescribed period. The customer bears all risk, in
particular the transport risk for consignments sent by the customer to the Pitztal
Tourist Office until the merchandise is received by the Pitztal Tourist Office
in Austria..
- The Pitztal Tourist Office is entitled as part
of the business relationship to record, store and to process personal data of
the customer.
- The invalidity of individual points of these General
Terms and Conditions of Business does not affect the validity of the remaining
provisions. A new provision is to replace the invalid provision which comes closet
to fulfilling the economic intent of the invalid provisions. Place of performance
and place of jurisdiction for contracts concluded including these General Terms
and Conditions of Business is Silz.
